Hmmmm, without wishing to sound protectionist, Small Claims does not = small issues. The legal issues and argument in Small Claims matters can be as complex as those raised in high value claims in the High Court.

This rise in value for cases to be heard under the SC regime has serious implications for costs that can be recovered by those who chose, or are more often forced down, the litigation route.

I appreciate that applications to “re-track” can be made when the issues become complex but how many “Joe Bloggs” know this and, if a lawyer isn’t on board from the beginning because of cost, who will advise them?
